Multi-Unit Residential Development Goes Forward.
Our Real Estate Development team won a Land Court trial for our client, a real estate developer, and then won the resulting appeal with a decision from the Massachusetts Appeals Court
The plaintiff brought suit against our client, challenging the Somerville Zoning Board of Appeals’ issuance of a special permit for the construction of a multi-unit residential project. The plaintiff claimed that she was aggrieved by the impacts of our client’s development, and that the Zoning Board of Appeals exceeded its authority by issuing the special permit.
The Appeals Court issued a decision fully affirming the Land Court’s judgment in favor of our client, ending the litigation and allowing completion of the project.
