The Massachusetts Fair Employment Practices Act is a state law that prohibits discrimination in employment. Codified under Massachusetts General Laws, Chapter 151B, the law requires certain standards during the hiring process, promotions, job assignments, termination, and other aspects of employment. The statute makes it illegal for employers, labor organizations, and employment agencies to engage in discriminatory practices based on several protected characteristics such as race, gender, religion, age, sexual orientation, disability, and more. The law safeguards individuals from retaliation when reporting workplace discrimination or when participating in investigations stemming from unlawful events.
Employers with six or more employees are subject to this law, and must comply with legal hiring, promotion, and disciplinary practices. Significantly, the Act extends protections to employees who have criminal records. It limits how information about an employee’s past can be used during the hiring process. The Act is enforced by the Massachusetts Commission Against Discrimination (MCAD). It is essential for employers to understand their rights and obligations under the Massachusetts Fair Employment Practices Act.
